Evictions

Do I really need a lawyer to evict a tenant?
In California, everything in an eviction is strictly construed — every document, starting with the notice, must be 100% correct and comply with both state and local law. The system is designed to be hard on landlords, especially in rent-controlled cities. One misstep can restart the whole case. Having an attorney who represents owners exclusively levels the playing field.
I already served a notice but the tenant won’t leave — can you help?
Yes. If your notice is legally correct, we proceed with the eviction action. If it isn’t, we prepare a compliant notice and start on solid footing. A legally correct notice is required for any eviction to succeed.
How long does an eviction take?
It depends on how quickly the tenant is served, whether they contest, and the court’s trial calendar. Some cases resolve in a few weeks; others take a few months. Darryl focuses on moving your case forward as quickly as the process allows.
Can you handle owner move-in (OMI) evictions?
Yes — for existing owners and for new buyers moving into a home after purchase. OMI evictions require strict compliance with notice periods and, in some cities, relocation payments. Darryl guides the entire process.
What happens if the tenant contests the eviction?
We respond to any motions the tenant files, handle discovery, attend settlement conferences, and prepare the case for trial. At each step you’ll know what’s happening and why — with the goal of the fastest, most efficient path to possession.

Security Deposits

What can I legally deduct from a security deposit?
A landlord may deduct for unpaid rent, repair of tenant-caused damage beyond ordinary wear and tear, and cleaning necessary to return the unit to its move-in condition. Deductions outside those categories invite disputes.
How soon must I return a deposit after move-out?
California requires you to account for the security deposit within 21 days of the tenant vacating the unit, with an itemized statement of any deductions.
What if the tenant caused damage beyond the deposit?
Under California law a tenant is liable for damage above ordinary wear and tear even when it exceeds the deposit amount. Darryl can help you document, demand, and pursue recovery.
